Terms of Service (New Zealand)

Welcome to Aroha Artisan (“Aroha Artisan”, “we”, “us”, “our”). We operate this website and store (the “Services”). These Terms of Service (“Terms”) govern your access to and use of the Services, including any purchase you make.

By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please don’t use the Services.

1. Eligibility & Accounts

  • You confirm you are legally able to purchase and possess our products in your jurisdiction and you’re using the Services for personal/household use.

  • You’re responsible for the accuracy of information you provide and for keeping your account credentials secure. You’re responsible for all activity under your account.

2. Products, Customisation & Engraving

  • We aim to describe and photograph products accurately; however, colours/appearance can vary by device and lighting.

  • Custom & personalised items. For engraving (names, dates, logos, artwork you supply), you:

    • Confirm you own or have the rights to use the content and that it doesn’t infringe others’ rights or breach any law.

    • Grant us a licence to use that content solely to produce your order and to display your finished product in our portfolio/store (you can opt out by telling us).

    • Approve any proofs we provide. After approval, changes may not be possible.

  • We may refuse or cancel orders containing unlawful, hateful, or infringing content.

3. Orders & Acceptance

  • Your order is an offer to buy. We accept only when we send an order confirmation (after payment authorisation). If we can’t accept or must cancel, we’ll refund any amounts paid.

  • Please check your details carefully before submitting—change/cancellation requests might not be possible once production starts (especially for personalised items).

4. Pricing, Taxes & Payment

  • Prices are in NZD unless stated otherwise and may change without notice. Taxes, shipping, and duties (if any) are shown at checkout.

  • You agree to provide current, complete billing/shipping details. If you use Afterpay or other third-party payment methods, their terms also apply.

5. Shipping, Delivery & Risk

  • We ship to the address you provide. Delivery timeframes are estimates.

  • Risk in goods passes on delivery to your address (or collection point you selected). Please inspect on arrival and notify us promptly of any transit damage.

6. Returns & Consumer Rights (NZ)

  • Our Returns & Refunds Policy (14-day change-of-mind, original condition/packaging, customer pays return shipping) forms part of these Terms: Returns & Refunds.

  • Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA). If your item is faulty or not as described, you are entitled to a repair, replacement, or refund under the CGA. For confirmed faults or our error, we cover reasonable return shipping.

7. Acceptable Use

You agree not to misuse the Services. This includes (without limitation): illegal activity; infringing others’ rights; submitting harmful code; scraping; interfering with security; or attempting to bypass purchase limits.

8. Intellectual Property

  • All site content, designs, imagery, product copy and original engravings/artwork we create are owned by Aroha Artisan or our licensors and are protected by law.

  • You may not copy, reproduce, distribute, or make derivative works without prior written consent. Purchasing a product does not transfer any IP rights.

9. Reviews & Feedback

If you submit reviews, photos or feedback (“Feedback”):

  • You grant us a worldwide, royalty-free licence to use, reproduce and display the Feedback in connection with the Services and our marketing (you can request removal).

  • You warrant you have the rights to share the Feedback and it’s lawful, accurate and not misleading. We may moderate or remove Feedback at our discretion.

10. Third-Party Services & Shopify

  • Our store is hosted by Shopify. Third-party services (e.g., payment providers, shipping carriers, analytics) may apply their own terms; please review them.

  • Sales are made by Aroha Artisan (not Shopify). You agree Shopify is not responsible for your purchase or any issues arising from it.

11. Warranties & Liability

  • Except as required by NZ law (including the CGA/FTA), the Services and all products are provided “as is” and “as available.”

  • To the maximum extent permitted by NZ law, we exclude liability for indirect, incidental or consequential loss, loss of profit, or loss of data. Where we cannot exclude liability, our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

  • This Section does not limit your non-excludable rights under NZ law.

12. Privacy

We handle personal information in accordance with the Privacy Act 2020 (NZ) and our Privacy Policy. Because we use Shopify, some information may be processed overseas to provide the Services.

13. Force Majeure

We’re not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, pandemics, courier disruptions, supplier issues).

14. Changes to the Services & Terms

We may update products, features and these Terms. Material changes will be posted here with an updated “Last updated” date. Your continued use after changes indicates acceptance.

15. Governing Law

These Terms are governed by the laws of New Zealand. You and we submit to the non-exclusive jurisdiction of the New Zealand courts.
